1. What this policy covers
1.1 This policy is part of the HypeLead Terms of Service (the “Service”). It applies to every use of the Service and to every channel through which the Service allows outreach. Today these are email and LinkedIn.
1.2 If the Service adds another channel, we will add rules for it to this policy before we make it available.
1.3 Terms have the same meaning as in the Terms of Service.
2. Lawful outreach
2.1 You, as controller and sender, are responsible for your outreach being lawful. You must have a legal basis for contacting each recipient, usually a legitimate interest assessed for the group of recipients.
2.2 Some countries require the recipient’s prior consent for unsolicited commercial email, including to business addresses. They include, for example, the Czech Republic (Act No. 480/2004 Coll.) and Germany. Where the law of the recipient’s country requires consent, you must have it.
2.3 For countries with stricter rules, the Service shows a warning and records your decision to continue. It does not block sending. The warning is not legal advice.
3. Truthful sender
3.1 Every message must make clear who is sending it. Use your real company name and your real name.
3.2 Forging headers, impersonating another person or company, and using a misleading subject or sender are prohibited.
3.3 A commercial message must be clearly marked as a commercial message. The footer the Service adds to campaigns (the text “Business offer from {Company}”, a privacy notice link and an unsubscribe link) provides this marking. Do not remove or hide it.
4. Unsubscribe and objections
4.1 Every campaign message contains a one-click unsubscribe link. The Service will not send a campaign message without it.
4.2 Unsubscribes and objections go onto the unsubscribe list, which applies to all channels and cannot be switched off. You must not try to get around it, for example by uploading the contact again under a different address.
4.3 If a recipient asks you to stop contacting them in another way, for example by replying, add them to the unsubscribe list.
5. First-contact notice
5.1 Before you first contact a person whose data you did not get directly from them, you must complete your privacy notice page in the Service. The Service links to it in the first message. The Service will not send a first email without a completed page.
5.2 On LinkedIn, include in the first message a short note that you process the recipient’s data, a link to your privacy notice and an option to decline further contact.
6. Prohibited data
6.1 You may not upload to the Service, or use for targeting:
- special categories of personal data (for example health, religion, political opinions, sexual orientation, ethnic origin, biometric data),
- data about criminal offences and convictions,
- lists of consumers, meaning people who are not acting for their trade, business or profession,
- personal addresses at free email providers, unless you have a documented legal basis for them and use the procedure the Service records for this.
6.2 The Service’s filter looks for and deletes special categories of data, but it does not catch everything. The responsibility stays with you.
7. Prohibited content and industries
7.1 You may not use the Service to promote or offer:
- adult content,
- weapons, drugs and other illegal goods or services,
- gambling without a valid licence,
- crypto investment schemes and get-rich-quick offers,
- debt collection,
- political campaigns,
- health claims and miracle cures,
- multi-level marketing (MLM),
- anything that is illegal in the sender’s or the recipient’s country.
7.2 You may offer regulated financial and health services only with our prior written approval.
7.3 Fraud, phishing, spreading malware, hate content, harassment, threats, misleading or deceptive claims, and content that infringes intellectual property rights are also prohibited.

8. Channel rules
8.1 Email. Send only from mailboxes and domains you own or are allowed to use. The domain must have correctly set SPF, DKIM and DMARC records; the Service checks this before sending.
8.2 LinkedIn. Follow LinkedIn’s rules. LinkedIn may restrict or block an account. Do not get around the pace and limits the Service sets.
8.3 Open and click tracking is off by default. If you turn it on, say so in your privacy notice.
9. Sending health
9.1 The Service monitors undelivered messages, spam complaints and unsubscribes for every mailbox and campaign.
9.2 If the values go past the thresholds set in the Service, the Service automatically pauses the mailbox or campaign. The thresholds and daily sending limits are the limits shown in your plan and in the app.
9.3 Do not send to lists with a high share of invalid addresses, and do not buy lists whose origin you cannot prove.
10. Misuse of the Service
10.1 It is prohibited to:
- get around sending limits, the unsubscribe list, mailbox warm-up or other protective measures of the Service,
- manipulate the warm-up pool, for example by sending real campaigns through it or artificially influencing its results,
- share a login between several people,
- create several accounts to get another trial,
- resell the Service or lead data,
- scrape the Service’s content automatically or load its interfaces beyond normal use,
- probe for vulnerabilities without following the procedure on /legal/report.
11. Content created by artificial intelligence
11.1 You may not use AI Features to write deceptive messages, for example to pretend a personal acquaintance, fake recommendations or made-up results.
11.2 The Service marks emails with content created by artificial intelligence in a machine-readable way. Do not remove this marking.
12. Enforcement
12.1 If this policy is broken, we act proportionately: a warning, pausing a campaign or mailbox, pausing sending, suspending the account, ending the contract. For a serious breach we may skip steps.
12.2 For every restriction we send you a statement of reasons under section 18 of the Terms of Service. You can challenge the decision.
12.3 Anyone can report misuse of the Service on /legal/report.
